Terms and Conditions of Order
Once you have registered online and/or have placed an order with PRINT5000, you have demonstrated that you agree to all of the following Terms and Conditions. Please read this section carefully. This is a legally binding contract with PRINT5000 for printing services rendered and you will be responsible for payment in accordance to our policies as explained later in this section. If you do not agree to our Terms and Conditions, please do not use our services.
Printing, Colour & Cutting
All cards are “gang printed. Only our proofs are calibrated for our presses.
Submitted projects that do not require a proof will be printed according to generally recognized industry standards. Keep in mind that because of variances in equipment, processing, proofing substrates, paper, ink, pigments, and other conditions between colour-proofing and pressroom operations, a reasonable variation in colour between colour-proofs and the completed job shall constitute an acceptable final product.
For projects that have critical colour-matching requirements, we strongly recommend purchasing a Press Match Proof. These proofs cost approximately $70 CAD or $50 US, at our discretion. Colour-matching of the Press Match Proof to the final product is usually about 85-90% however, we do not guarantee exact colour-matching. Please also keep in mind that your monitor’s calibration affects the colour images you will see on your screen when creating a project for print and when viewing a proof.
Because of limitations encountered in the printing process, such as restrictions of neighbouring colours and overall colour choices, ink matches are often very close, but not exact replicas of the original image. Needless to say, we will always do our best to produce the best, most accurate product possible; however, we accept no responsibility for colour variations between submitted work and the final product we provide to our clients.
All files submitted for printing must meet the following requirements:
1. Files must have a 1/8” bleed around entire document.
2. Critical type and/or images must be at least ¼” from the edge of the card. If you require a border around your card, we strongly recommend that it is at least ¼” thick. If it is too thin, the border may be uneven around the edge of the card.
If submitted work does not meet these requirements, or if PRINT5000 believes that submitted work may be distorted or lost during the printing process, a fee of at least $25 may apply in order to properly format the submitted product. If you choose not to follow our guidelines, we are not responsible for type, art or images that are lost or distorted in the printing process.
All cards are "gang printed." PRINT5000., will reproduce colour from digital layouts as closely as possible, but cannot exactly match colour and density because of limitations in the printing process, as well as neighbouring image ink requirements. The accuracy of each colour reproduction is guaranteed to be within 85-90% to the press match proof we offer. We accept no responsibility for colour variations between submitted images and the actual artwork or product they represent.
All files must have a 1/8" bleed all around. A $25 fee may be charged to create a bleed if it has not been incorporated in your files. This fee is solely at our discretion.
Critical type or images must be at least 1/4" from the edge of the card. PRINT5000, is not responsible for type, art or images that are cut off if these guidelines are not followed. Furthermore, it is strongly suggested that you do not use a thin border around your postcard. This may cause an uneven frame around your card. If you desire to have a border, it should be at least 1/4" thick.
Turnaround
Our estimated turnaround time begins once orders have met the following conditions:
- Order Form has been accurately filled out and submitted online
- All files meet our format requirements
- When applicable, our client has approved the online proof, verbally or by email
- Payment information has been provided
Once material has met all of our criteria, it will be held in priority sequence until our next cut-off day and time. Currently, we have one cut-off time per week: MONDAY'S AT 5PM MST. If a project has not met all of our necessary criteria, it will not be sent to press until the next Monday. We feel that we are very efficient, rarely varying from production schedules and promptly actioning our clients’ requests; however, we depend on press equipment that is subject to malfunctions and/or mechanical failure. As well, we at times are unable to complete jobs due to human error, statutory holidays and other applicable reasons. As a result, our production and delivery times are not contractual and we do not provide a guaranteed turnaround time. No written or verbal correspondence by anyone at PRINT5000 will guarantee anything outside of what we have explained in our Terms and Conditions regarding “turnaround.” Having said this, we are happy to assist you in planning your timeline and recommend submitting projects in a timely fashion.
PDF Proofs
Files are checked on a first come first served basis. If a PDF proof is requested it can take up to around 24 hours before your files are checked due to the large volume of orders we receive. If your files are set up correctly you will receive an e-mail with a link to your on-line proofs. PDF proofs are meant to check for layout only and not meant to check colours. We also suggest that if your job is colour critical, you purchase a press match proof. This proof normally costs $70 CAD & $50 US. Please keep in mind that while we will try our best to match proofs, PRINT5000, DOES NOT GUARANTEE COLOUR MATCHING.
PDF proofs will NOT be sent out for the following formats: PSD, TIF, JPG, BMP, GIF, PCX, PNG, and PDF. These formats are flattened where images and fonts will not change. Customers will not be notified and production will start on these orders immediately.
Colour Matching and Proofs
Files are checked for our criteria fulfillment on a first-come, first-serve basis. If you request a PDF proof, it may take up to 24 hours before we can action your request. In this case, and if your files meet our criteria, you will receive a link to your online proof. The proof we provide is to satisfy your layout requirements and is NOT a colour proof. If your project is colour critical, please purchase a Press Match Proof as described in the Printing, Colour & Cutting section of this article.
PDF proofs will NOT be sent out for the following formats: PSD, TIF, JPG, BMP, GIF, PCX, PNG, and PDF. These formats are like snapshot images, meaning that images and fonts will not change. Clients will not be notified and production will start on these orders immediately.
Warranty
Although it is unlikely that an error will occur in our production process, PRINT5000 employs the following Claim process that must be completed by our clients to rectify issues with materials produced:
- Client must contact PRINT5000 immediately after the error has been discovered.
- A written Claim, outlining the defects, damages and/or shortages, must be submitted within fifteen (15) days after delivery of the partial or complete order. Failure to submit this Claim will illustrate your acceptance of the order AS IS with no refunds, exchanges, completion, and/or reconciliation of your project.
- Once PRINT5000 has reviewed the project and the submitted claim, a determination will be made by PRINT5000 to rectify the Claim. The rectification will always be made at our discretion and in some cases the claim will be disqualified if the request exceeds our warranty. Each situation is different and we will decide an appropriate plan of action for each Claim we receive. Examples of rectification include discount or re-print and in no case will include special or consequential charges to PRINT5000, such as expenses, shipping or profits lost.
- Our warranty only covers defects in our workmanship and materials. We are not liable for defects in the files submitted by the client for printing.
- Over-runs and under-runs are not to exceed 10% of the order.
Promotion
We reserve the right to use all of our projects as promotional material in print and/or display. If you would like your project to be kept private, a written request must be submitted with your order and we will honour that request to the best of our ability.
Payments
NO REFUNDS will be issued once an order has been sent to production. Furthermore, we do not provide partial and/or complete refunds for work not completed.
If you require any modification to your PDF proof, you will be charged at least $25. We urge clients to proofread all materials prior to submission and NOT to use our PDF services as a way of editing final content.
Should you decide to cancel your order once the PDF proof has been generated, you will incur a mandatory $50 fee. This fee is not negotiable and will be charged in full.
Refund & Cancellations
Once an order has been received and has entered the production cycle, refunds are not allowed. No partial refunds given for work not completed. Customers requiring modifications to their order after viewing PDF proofs will be charged a $25 fee. We urge clients to proof read all materials prior to submitting artwork and not to use our free PDF proof service as a way of checking final content. Customers wishing to cancel orders once PDF proofs have been generated will incur a mandatory $50 fee. This fee is not negotiable and will be charged in full.
Materials Working materials, such as mechanical art, type, negatives, positives, digital files, flats, plates and other items, provided by PRINT5000, will remain our exclusive property unless otherwise stated in writing by one in authority at PRINT5000. By submitting projects to PRINT5000, you certify that you own the rights to use the image(s) and/or verbiage you have provided. Never send original or “one-of-a-kind” work or materials. We are not responsible for loss or damage of the materials you provide.
Insurance of Customer's Property
We provide insurance coverage on all materials in our possession against fire, vandalism, malicious mischief, and sprinkler leakage. Our liability shall never exceed the amount recoverable from our insurance. If your material(s) hold extraordinary value, it is strongly recommended that a special insurance policy be organized prior to submitting material to PRINT5000.
Taxes
All orders placed and paid for in Canada are subject to 5% GST.
USA orders are tax exempt. Materials printed in Canada ship duty-free to the USA under the NAFTA Agreement.
Shipping & Handling
Delays, damage or loss of packages during shipping are the sole responsibility of the carrier providing shipping services. PRINT5000 will not be held responsible for any delays, damage or loss of packages experienced during shipping. PRINT5000 will not be liable for any claims such as loss of business or problems due to shipping delays and/or damage to the product.
Indemnification
By submitting an order form and beginning the production process with PRINT5000, our clients demonstrate their indemnification of PRINT5000. That is to say, our clients agree to hold us harmless against loss, damages, expense, and cost, such as legal fees, in all matter of claims, demands, actions, and proceedings that may be instituted against us, such as the accusation of violation of copyrights or any proprietary right of any person, or that a product contains matter that is libellous, obscene or scandalous or if matter invades personal rights and/or privacy, except in the obvious circumstance in which we contributed to such matter. Our clients agree to defend PRINT5000 against any such claim, demand, action or proceeding that may arise provided that we, PRINT5000, will promptly notify the client regarding the situation giving our client the opportunity to defend us.
